These Terms of Use ("Terms") constitute a binding legal agreement between you and Halis Kara governing your use of our mobile applications ("App" or "Apps"). By downloading, accessing, or using our Apps, you agree to be bound by these Terms and our Privacy Policy.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR APPS.
1. License and Scope of Use
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Apps solely for your personal, non-commercial purposes strictly in accordance with these Terms.
You agree not to:
Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Apps.
Use the Apps for any illegal purpose or in violation of any local, state, national, or international law.
Exploit the Apps for any commercial purpose without our prior written consent.
Harass, abuse, or harm another person via the Apps.
2. IMPORTANT DISCLAIMERS (Health, Education, & Utilities)
A. No Medical Advice (For Health & Fitness Apps) Our Apps may provide information related to health, fitness, nutrition, or medical conditions. This information is for informational and educational purposes only and is NOT medical advice, diagnosis, or treatment.
You should always consult with a physician or healthcare professional before making any healthcare decisions or starting any fitness program.
Never disregard professional medical advice or delay in seeking it because of something you have read in our Apps.
Reliance on any information provided by our Apps is solely at your own risk.
B. Educational & Informational Content For Apps providing educational content, language learning, or utility tools, we do not guarantee specific results, academic improvements, or absolute accuracy of data. Content is provided as a supplementary tool and should not be the sole source of information for critical decisions.
C. AI and Recognition Accuracy Some Apps use Artificial Intelligence (AI) and image recognition technology (e.g., for scanning documents, identifying objects, or translation). You acknowledge that AI technologies are not infallible. We do not guarantee 100% accuracy of any scan, identification, or translation. You should verify critical information independently.
3. Subscriptions & Payments
Some Apps utilize the "In-App Purchase" mechanism allowing you to purchase subscriptions (weekly, monthly, yearly, or lifetime) or consumables.
Processing: All billing and transactions are handled entirely by the Apple App Store. We do not store your credit card information or process payments directly.
Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Cancellation: You can manage and cancel subscriptions in your Apple ID Account Settings. Uninstalling the app does not cancel your subscription.
Refunds: As we do not manage payments, we cannot issue refunds directly. All refund requests must be submitted to Apple Support.
4. Intellectual Property Rights
The Apps and their entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, images, video, and audio) are owned by Halis Kara, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.
5. Third-Party Services and Links
Our Apps may contain links to third-party websites or services (e.g., external articles, APIs, commercial platforms) that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
6. Disclaimer of Warranties
THE APPS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HALIS KARA BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE APPS.
8. Indemnification
You agree to defend, indemnify, and hold harmless Halis Kara and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) resulting from your violation of these Terms or your use of the Apps.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Apps following the posting of revised Terms means that you accept and agree to the changes.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Insert Your Country/State, e.g., Turkey], without regard to its conflict of law provisions.
